ELM GROVE LIBRARY HALL DISPLAY CASE POLICY
The Elm Grove Public Library (EGPL) provides a display case in the lobby outside of the library entrance for the informational, cultural, and civic interests of the community. Although EGPL sponsored displays take precedence, the display case is available to non-profit community groups, as well as individuals, subject to this Policy as administered in the discretion of the Library Director. The length of time for use of the display case will be determined by the Library Director and generally will be limited to two weeks or less in duration.
APPLICATION TO USE DISPLAY CASE
An application must be made in person by completing an application form available at the EGPL circulation desk. The Applicant must certify ownership of or legal authority over the items to be displayed. Applications, which must be submitted at least two weeks in advance of the proposed display, will be reviewed by the Library Director or her designee. If approved by the Library Director, displays will be scheduled on a first come, first served basis consistent with the needs of the EGPL. The EGPL reserves the right to reschedule displays based on its needs and those of the Village of Elm Grove.
TERMS AND CONDITIONS
The Applicant acknowledges and agrees to comply with the following terms and conditions:
1. All advertisements, announcements, news releases, flyers, etc. relating to the display must clearly state that the display and its content are not sponsored or endorsed by EGPL and that EGPL is not responsible for the accuracy of statements contained in or relating to the display. The display must indicate who prepared the display and who to contact for further information. Any accompanying printed materials must be displayed inside the display case.
2. The Applicant is solely responsible for set up, installation and take down of his or her display. All set up, installation and take down of the display must be performed during the time determined by the Library Director. The EGPL reserves the right to photograph all or any portion of the display.
3. The display case may not be used by individuals or groups meeting the following criteria:
- previously failing to comply with this Policy as determined by the Library Director or the requirements and practices of the Village of Elm Grove applicable to the Village Hall.
- furthering the private business or financial interests of for-profit organizations or of individuals.
- engaged in fundraising, excluding displays supporting the EGPL which are approved in advance by the Library Director.
- appearing to be advocates with respect to a political, moral or social issue as determined by the Library Director or otherwise conflicting with the past or current practice of the EGPL and/or the display practices of the Village of Elm Grove.
4. The Library Director reserves the right to reject, limit, alter, remove or prohibit at any time all or any part of any display that the Library Director determines is objectionable, unsafe or not suitable for display, including any display which represents a potential threat to the health or safety of the public (e.g., firearms or weapons) or the orderly use of the EGPL or Village Hall, including any display which has bee arranged in a manner not in conformity with the stated description on the application form.
5. The Applicant shall retain all risk of loss, damage, destruction and theft of the property displayed or used while on the premises or in the possession of the EGPL and the Applicant agrees that neither the EGPL nor the Village of Elm Grove is responsible for any such risk.
6. Displays must conform to all applicable laws including those prohibiting obscenity, libel, defamation and those protecting privacy.
7. Any violation of this Policy or Village of Elm Grove requirements may result in the denial of use or continued use of display space, as determined by the Library Director.
8. Displays may not include offers for sale of items or services except for those groups espousing activities of the Village of Elm Grove or other groups in support of EGPL.
9. The EGPL may post a sign clearly stating that “The display is not sponsored or endorsed by the Elm Grove Public Library or the Village of Elm Grove.”
